Seeking the opinion of the Commissioner of the Japan Patent Office

When identification procedures have been initiated by Customs, a right holder (i.e., patent right, utility model right or design right) or an importer may request Customs to seek the opinion of the Commissioner of the Japan Patent Office regarding the technical scope as to whether the goods are infringing the relevant right.
If necessary, Customs may seek the opinion of the Commissioner of the Japan Patent Office on its own initiative pursuant to the procedure.
